Art. 32, comma 2 della Costituzione: Nessuno puo' essere obbligato a un determinato trattamento sanitario se non per disposizione di legge. La legge non puo' in nessun caso violare i limiti imposti dal rispetto della persona umana.

P.S. Si lo so che il Legislatore se ne frega dei miei promemoria, ogni tanto però leggersi la Costituzione farebbe bene a tutti....

Nei giorni che hanno preceduto l'ultimo viaggio di Eluana mi sono lasciato ossessionare dai problemi che poneva la vicenda. Ovviamente avendo manifestato la mia opinione che bisognava lasciare andar via la ragazza, mi sono sentito dare anche io del nazista. I did not hurt much. A questo punto la mia mente è quasi sopraffatta dall’immagine di un enorme, quasi infinito, stanzone in cui un’umanità completamente folle e rincitrullita manterrebbe in stato di vita assistita tutte queste persone dalle facoltà cognitive irrimediabilmente compromesse. La vita umana, dicono alcuni, deve essere preservata ad ogni costo, dall’inizio alla fine. Ma proprio dall’inizio inizio e per sicurezza da quando lo spermatozoo si trova a qualche millimetro dalla cellula uovo, fino a quando morirà l’ultimo meccanico in grado di aggiustare le macchine. Ma la tecnologia progredisce in fretta e domani potremmo trovarci di fronte a nuovi e imprevedibili metodi per prolungare la vita.
Il problema a mio modesto avviso non è capire quando c'è la vita o quando la morte. Piuttosto dobbiamo avere il coraggio di chiederci correttamente quando è lecito togliere la vita; perché non si tratta più di una persona ma di una “res” che non è lecito continuare a venerare come se si trattasse di un sepolcro a cielo aperto (“lasciate che i morti seppelliscano i loro morti”).
Mi accorgo che questo discorso porterebbe via troppo tempo. Non me la sento di affrontarlo se non altro perché l’accusa di nazismo mi pesa ancora addosso come un macigno.
